Federal Regulations Relating to Property

Overview

Universities have many regulations to comply with. Primarily, we follow the instructions under the Office of Management and Budget, however, we are also required to follow regulations under the Federal Acquisition Regulations (FAR). Above all, we follow whatever requirements are outlines in individual agreements. Sometimes these rules, regulations, and requirements are in sync with each other, and sometimes they conflict. Your Property Service Representative (PSR) is available to assist you with interpreting and complying with federal regulations. Individual consultations as well as copies of federal regulations are available from PMO.

If the award is from a government agency, and there is no mention of capital equipment, then allowability provisions in OMB Circular A-21, Section J.13 apply:

“J.13a(3) Special Purpose Equipment means equipment which is used only for research, medical, scientific or other technical activities.

“J.13a(4) General Purpose Equipment means equipment, the use of which is not limited only to research, medical, scientific or other technical activities. Example of general purpose equipment include office equipment and furnishings, air conditioning equipment, reproduction and printing equipment, motor vehicles, and automatic data processing equipment.

“J.13b(1) Capital expenditures for general purpose equipment, buildings, and land are unallowable as direct charges, except where approved in advance by the sponsoring agency.

“J.13b(2) Capital expenditures for special purpose equipment are allowable as direct charges, provided that the acquisition of items having a unit cost of $1,000 or more is approved in advance by the sponsoring agency.

“J.13b(3) Capital expenditures for improvements to land, buildings, or equipment which materially increase their value or useful life are unallowable as direct charges, except where approved in advance by the sponsoring agency.”

Screening Requirements

Screening is the process of ensuring, either prior to purchase or concurrently with purchase, that the same or equivalent piece of equipment is not excess or otherwise available to share. Each sponsor or agreement may have different screening requirements. Please check your individual agreements for requirements. If you have a lot of agreements with one particular sponsor, you should become familiar with that sponsor's general requirements. Please see Screening in Chapter 2 "Acquisition" for details on when and how to perform screening.
