DoE Current and Pending Support Resources

The DOE and NNSA will include this requirement in proposal solicitations and agreements, including continuation awards.  Some programs, such as those that exclusively fund workshops, and some award types, such as Other Transactions, may be exempt from the Common Form requirement, but a program has the flexibility to require it.

Proposals

The Notice of Funding Opportunity (“NOFO”) will specify the disclosure requirements of the program.  Review the NOFO to ensure a proposal is prepared on the required forms.  

In the NOFO instructions, the DOE/NNSA program offices may: 

  1. Specify whether a persistent identifier (PID) is required or not.
  2. In addition to current support and pending support, also require disclosure of past support “for reasons specified by statute, regulation, specific agency authorities, or other compelling reasons”.
  3. Specify what types of activities to disclose on the CPS Common Form in cases where it is used for:
    • Non-R&D NOFOs and awards
    • Covered individuals* outside of academia or research-based professions; and/or
  4. Require disclosure of additional information, and/or disclosure from a broader range of participants, either as a matter of course or upon request:
    • Modify the disclosure requirements for “Travel supported/paid by an external entity to attend a conference or workshop” when the conference/workshop and/or supporting entity is located in a Foreign Country of Concern (FCOC).
    • Require a Current and Pending Support Addendum.  The Addendum is available on SciENcv at the bottom of the SciENcv Current and Pending Support form.

Otherwise, the DOE/NNSA will implement the CPS Common Form in SciENcv without change to any collection fields, and the below guidance applies.

Current and Pending Support Definition

  • (a) All resources made available, or expected to be made available, to an individual in support of the individual’s research and development efforts, regardless of
    • (i) whether the source is foreign or domestic;
    • (ii) whether the resource is made available through the entity applying for a research and development award or directly to the individual;
    • (iii) whether the resource has monetary value; and
  • (b) includes in-kind contributions requiring a commitment of time and directly supporting the individual’s research and development efforts, such as the provision of office or laboratory space, equipment, supplies, employees, or students.  This includes resource and/or financial support from all foreign and domestic entities, including but not limited to, financial support for laboratory personnel, and participation of student and visiting researchers supported by other sources of funding.

Proposals and Active Projects

In this section, disclose ALL proposals and active projects irrespective of whether such support is provided through the Stanford or is provided directly to the individual. Examples of sources include Federal, State, local, foreign, public or private foundations, non-profit organizations, industrial or other commercial organizations or internal funds allocated toward specific projects.

  • In addition to all externally funded proposals and projects, investigators must also disclose in this section all of their University Research Awards and internal seed grants/research awards issued in Stanford gift PTAs.
  • Total Anticipated Proposal/Project Amount: Enter the total award amount for the entire period of performance, inclusive of indirect costs, rounded to the nearest dollar. If the dollar value is not readily ascertainable, a reasonable estimate should be provided. If the support is in a foreign country’s currency, convert to US dollars at time of submission.
  • Person Months: Enter how much time the individual anticipates is necessary to complete the scope of work on the proposal and/or active project. Enter the number of person-months (even if unsalaried) for the current budget period and enter the proposed person-months for each subsequent budget period. If the time commitment is not readily ascertainable, a reasonable estimate should be provided*.  
    • *Note: SciENcv requires at least 0.01 person months to be entered for any person month entry.  Moreover, keeping in mind one of the primary purposes of a Current and Pending document/disclosure is for sponsors to assess the capacity of investigators to take on new projects, the Person-Month(s) or (Partial Person-Months) per year listed for a project should always be a reasonable approximation of how much time the individual is planning to spend to complete the given project, even if project does not require a measurable effort commitment, as is commonly the case for University Research Awards (URAs), seed grants, and awards/projects classified as Other Sponsored Activities (OSAs).

Consulting Activities 

Consulting activities must also be disclosed under the proposals and active projects section of the common form when any of the following scenarios apply:

  • The consulting activity will require the senior/key person to perform research as part of the consulting activity;
  • The consulting activity does not involve performing research, but is related to the senior/key person’s research portfolio and may have the ability to impact funding, alter time or effort commitments, or otherwise impact scientific integrity; or
  • The consulting entity has provided a contract that requires the senior/key person to conceal or withhold confidential financial or other ties between the senior/key person and the entity, irrespective of the duration of the engagement.
  • Note: Under the proposals and active projects section of the common form the Total Anticipated Proposal/Project Amount field must be completed, even for consulting activities.  When a consulting activity that meets the criteria for disclosure does and/or will NOT provide remuneration to the investigator, $0 is a valid entry for Total Anticipated Proposal/Project Amount field in SciENcv.  However, when a consulting activity that meets the criteria for disclosure does and/or will provide remuneration to the investigator, the actual dollar amount the investigator does and/or will receive must be entered in the Total Anticipated Proposal/Project Amount field in SciENcv.  Additionally, the number of person-months (or partial person-months) per year the investigator is and/or will devote to the consulting activity must be entered in the relevant Person Months field(s). 

In-Kind Resources

An in-kind contribution is a non-cash contribution provided by an external entity that directly supports the individuals' research and development efforts. An in-kind contribution may include but is not limited to: real property; laboratory space; equipment; data or data sets; supplies; other expendable property; goods and services; employee or student resources. 

  • In-kind sources of support intended for use on a proposal being submitted to NSF should be included in the Facilities, Equipment and Other Resources section of the given proposal.
  • In-kind sources of support NOT intended for use on a proposal being submitted to NSF should be included in the given investigator's Current and Pending Support disclosures under the In-Kind section. 

In-kind resources that must be disclosed are limited to those with an estimated dollar value of $5000 or more and that require a commitment of the individual's time.  In-kind contributions with an estimated value of less than $5000 need NOT be reported.

Common Examples of In-Kind Support

  • Postdoctoral scholars, students, or visiting scholars who are supported by an external entity e.g. a fellowship and/or an industrial affiliates program sponsor, whose research activities are not intended for use on the project/proposal being proposed
  • Awards made directly to project personnel e.g. "paid direct" fellowships.
  • Data sets
  • Biological or chemical materials
  • Office/laboratory space, equipment or supplies
  • Travel supported/paid by an external entity to perform research activities with an associated time commitment
  • Honoraria or other payments for research-related activities paid by an external party with an associated time commitment

“Gifts”

A gift is defined as to be something that is given without the expectation of anything in return.  An item or service given with the expectation of an associated time commitment or if the donor receives a benefit is not a gift, and is instead an in-kind contribution and must be reported as such if the monetary value is $5K or greater. Examples include, but are not limited to, funds received in support of an Industrial Affiliates Program (IAP) with the expectation of an associated time commitment from the investigator and/or if member companies are offered benefits, and/or gifts where the donor will receive a benefit (e.g. access to research results, students or facilities)

While Stanford University policy on gifts aligns closely with this definition, there may be gifts that could come into question. As a result, we ask Investigators to use the guide document linked below to carefully consider and identify any gift that meets the criteria for disclosure for Commons Form Current & Pending Support.

Disclose as in-kind resources all gifts that meet the criteria listed in the Stanford Common Form Gifts Disclosure Guidance.

For gifts that do meet the criteria for disclosure and have a current balance of $5K or more*:

  • Use the current gift award balance shown in FFIT as the $ amount of the in-kind resource.  
  • For gifts that are pooled i.e. funded from multiple donors, the source of support can be listed as "multiple donors".

*Disclose any current Seed Grants that are awarded in gift funds as Current projects even if their current balance is less than $5K.  Gift PTAs listed under "Allocations from Others" are very often seed grants.  Running the OBI Fund Authorization Report and speaking with your faculty can confirm and provide any additional needed information.

Certification and Limits on Participation in Certain Foreign Talent Recruitment Programs

Each covered individual is required to complete the following certifications regarding the information provided in their Current and Pending (Other) Support:

I understand that I have been designated as a covered individual by the Federal funding agency.

I certify to the best of my knowledge and belief that the information contained in this Current and Pending (Other) Support Form is true, complete, and accurate. I understand that any false, fictitious, or fraudulent information, misrepresentations, half-truths, or omissions of any material fact, may subject me to criminal, civil or administrative penalties for fraud, false statements, false claims or otherwise. (18 U.S.C. §§ 1001 and 287, and 31 U.S.C. 3729-3733 and 3801-3812). I further understand and agree that (1) the statements and representations made herein are material to DOE’s funding decision, and (2) I have a responsibility to update the disclosures during the project period of the award should circumstances change which impact the responses provided above.

I also certify that, at the time of submission, I am not a party in a malign foreign talent recruitment program. I further understand should I take action to involve myself with a Malign Foreign Talent Recruitment Program during the period of performance of the award, I must notify the recipient’s Authorized Agent immediately, but no later than five business days of taking such action and immediately recuse myself from all DOE awards.

If this is an R&D proposal/award, I also certify to the following statement:

Within the past 12 months I have completed research security training meeting the requirements in SEC. 10634(b) of 42 USC 19234.

After proposal selection and during the life of the award

  • If a recipient or subrecipient wishes to add a new covered individual* to the project, such person(s) must submit the Biosketch and CPS Common Forms and obtain DOE approval prior to joining the project team.
  • For previously approved covered individuals*, if there are changes to the previously submitted Biosketch or CPS Common Form, the individuals must update their disclosures within 30 days of the change, or on a timeline consistent with the program office instructions.

*Covered Individuals 

The DoE Notice of Funding Opportunity and/or terms and conditions of the award will specify the list of designated roles that are considered “Covered Individuals”.  At a minimum, this includes (PI); project director (PD); co-principal investigator (Co-PI); co-project director (Co-PD); project manager; and any individual regardless of title that is functionally performing as a PI, PD, Co-PI, Co-PD, or project manager.  The definition of Covered Individuals is program-specific, and the DOE may expand the list of Covered Individuals.
