Special Instructions for Joint University and Department of Veterans Affairs (VA) Appointments

Service Agreement/Fee-for-Service Projects Common Forms Disclosure Guidance

A table entitled, NSPM-33 Implementation Guidance Pre- and Post-award Disclosures Relating to the Biographical Sketch and Current and Pending (Other) Support has been created to provide helpful reference information regarding pre-award and post-award disclosures. 

Individuals are reminded not to submit any personal information in the current and pending (other) support. This includes items such as: home address; home telephone, fax, or cell phone numbers; home e-mail address; driver’s license number; marital status; personal hobbies; and the like. Such personal information is not appropriate for the current and pending (other) support template and is not relevant to the merits of the proposal. 

A separate entry within the NIH SciENcv Common Form for Current and Pending Support (CPS) must be provided for each proposal and active project, as well as in-kind contributions using the instructions and format specified below. Note that there is no page limitation for this section of the application, though some fields have character limitations for consistency and equity.

Consulting Activities

Consulting activities must be disclosed under the proposals and active projects section of the CPS form when any of the following scenarios apply:

  • The consulting activity will require the senior/key person to perform research as part of the consulting activity;
  • The consulting activity does not involve performing research, but is related to the senior/key person’s research portfolio and may have the ability to impact funding, alter time or effort commitments, or otherwise impact scientific integrity; or
  • The consulting entity has provided a contract that requires the senior/key person to conceal or withhold confidential financial or other ties between the senior/key person and the entity, irrespective of the duration of the engagement.

Recommendation on How to Disclose Consulting Agreements

Under the Proposals and Active Projects section of the common form, a consulting activity that meets the criteria for disclosure should be listed as if it were a regular “project”, with the following supplemental guidance:

  1. Primary Place of Performance: The listed primary place of performance should NOT be Stanford University, since this is not a Stanford activity.
  2. Statement of Overlap: Include the following text: “These activities are performed as a non-Stanford research activity in accordance with University policy. [Investigator to add any additional information or confirmation of no other overlap.]”
  3. The Total Anticipated Proposal/Project Amount field must be completed, even for consulting activities.  When a consulting activity that meets the criteria for common forms disclosure does and/or will NOT provide remuneration to the investigator, $0 is a valid entry for Total Anticipated Proposal/Project Amount field in SciENcv.  However, when a consulting activity that meets the criteria for common forms disclosure does and/or will provide remuneration to the investigator, the actual dollar amount the investigator does and/or will receive must be entered in the Total Anticipated Proposal/Project Amount field in SciENcv.  
  4. For the Person-Month(s) section: Enter the number of person-months (or partial person-months) the investigator is and/or will devote to the consulting activity per year. This number cannot be 0. This time is not considered part of their Stanford University FTE.  Investigators should also ensure that they have disclosed all relevant outside professional activities within the Stanford Outside Professional Activities Certification System (OPACS).

Additionally, consistent with NSPM-33, individuals are required to disclose contracts associated with participation in programs sponsored by foreign governments, instrumentalities, or entities, including foreign government-sponsored talent recruitment programs. Further, if individuals receive direct or indirect support that is funded by a foreign government-sponsored talent recruitment program, even where the support is provided through an intermediary and does not require membership in the foreign government-sponsored talent recruitment program, that support must be disclosed. Individuals must also report other foreign government sponsored or affiliated activities. In accordance with 42 USC § 19232, individuals are prohibited from being a party in a malign foreign talent recruitment program.

Supporting Documentation

For NIH, institutions are required to submit copies of contracts specific to senior/key-personnel foreign appointments and/or employment with a foreign institution for all foreign activities and resources that are reported in Current and Pending (Other) Support in a separate field alongside the Current and Pending (Other) Support document when submitting via the Just-In-Time, RPPR, or Prior Approval modules. If contracts are not in English, recipients must provide translated copies (see NIH GPS 2.5.1). This does not include personal service contracts, or employment contracts for fellows supported by foreign entities.

Investigators should submit copies of these external agreements for Stanford review through the Stanford Outside Professional Activities Certification System (OPACS) to ensure compliance with Stanford policy.  Additional information about this can be found on the DoR website

NIH Common Form for Current and Pending (Other Support) Format & Instructions

  1. Log into SciENcv - Upon login you will be navigated to either:
    • Your My NCBI landing page (your page URL will be https://www.ncbi.nlm.nih.gov/myncbi/ ).  On the lower right of your My NCBI landing page will be a blue Manage SciENcv hyperlink.  Click it.  
      • Administrators: If you have been granted delegate access to any of your investigators, you will see their email listed on the lower right of your My NCBI screen under Delegated CV :.  To enter information on your investigator's behalf, click on the relevant investigator's email.
    • Alternatively, you may be logged into the My NCBI SciENcv info page (your page URL will be https://www.ncbi.nlm.nih.gov/sciencv/).  On the lower left of this page you should see "You are here: MyNCBI > SciENcv > SciENcv: Science Experts Network Curriculum Vitae".  Click on the blue SciENcv hyperlink.
  2. You should now be on your SciENcv landing page (your page URL will be https://www.ncbi.nlm.nih.gov/labs/sciencv/ ).  Review your My Profile, and complete all fields, as needed by clicking on the blue Edit button.

  • Remember - Investigators MUST link both their ORCID iD and eRA Commons account to their SciENcv account.  If you do NOT see your ORCID iD and/or eRA Commons ID listed on your "My Profile", either click on your account name in the upper right of the screen, or click the blue Edit link next to "My Profile", and complete the requisite account linkages.
    • Administrators: If you have been granted delegate access to any of your investigators, when you navigate to your SciENcv page and scroll to the bottom, you should see their emails listed under Delegated SciENcv Accounts.  To enter information on your investigator's behalf, click on the relevant investigator's email.
      • If you are a delegate working for another investigator, DO NOT try to add the investigator's ORCID if it's missing from their profile section.  The investigator MUST log into SciENcv themselves and link their ORCID to their profile themselves.
  1. Click the blue + New Document button.
  2. Enter a Document Name - this can be whatever you like.
  3. Select from the Document Type dropdown menu NIH Current and Pending (Other) Support Common Form.
  4. Select whichever Data Source you would like to use:
    1. Use an existing document in SciENcv - allows you to import data from another SciENcv biosketch you have previously created, if any.
    2. Upload an XML file - SciENcv provides an XML template individuals can leverage for this, but most are finding it more efficient to either use an existing document in SciENcv, if one exists, or starting with a blank document and copying and pasting where data is  directly transferrable from an offline document e.g. a historical NIH Other Support word document.
    3. Start with a blank document
  5. Click the blue Create button and follow the on screen and/or below instructions to complete the form fields.

Identifying Information, Organization and Location

All fields for this section should auto-populate from an investigator's SciENcv Profile, if the investigator has a complete SciENcv profile.  If any field in this section does not auto-populate, exit the document and return to the investigator's SciENcv landing page and confirm that their SciENcv profile is complete, including displaying their ORCID ID, as below shown.  Once an investigator has a complete profile, as below shown, you can then either create a new document, and the new document's Identifying Information, Organization and Location fields should auto-populate, or you return to your existing, in-progress document and click the blue Edit link next to Identifying Information, Organization and Location, complete any uncompleted fields, and click Save.

*Proposals and Active Projects

In this section, disclose ALL proposals and active projects in accordance with the definition for current and pending (other) support and consulting activities that meet any of the above criteria for disclosure of consulting activities.

*Title: 

Enter the title of each proposal/active project being reported.

*Status of Support: 

Select the appropriate status type as defined below:

  • Current – all active projects, or projects with ongoing obligations, from whatever source irrespective of whether such support is provided through the proposing organization or is provided directly to the individual.
  • Pending – any proposal that is being considered for funding from a potential funding organization (including this proposal) irrespective of whether such support is provided through the proposing organization or is provided directly to the individual.

Proposal/Active Project Award Number (if available): 

Enter the applicable proposal/active project award number for each proposal and/or active project, if available.

*Source of Support: 

Identify the entity for each proposal and/or active project that is providing the support. Include all Federal, State, Tribal, territorial, local, foreign, public or private foundations, non-profit organizations, industrial or other commercial organizations, or internal funds allocated toward specific projects.

*Primary Place of Performance: 

Identify the primary location where the proposal and/or active project is being executed. Enter the City, State/Province, and Country where the organization is located. If the State/Province is not applicable, enter N/A.

*Proposal/Active Project Start Date: 

Indicate the start date (MM/YYYY) of the project, as proposed/awarded.

*Proposal/Active Project End Date: 

Indicate the end date (MM/YYYY) of the project, as proposed/awarded.

*Total Anticipated Proposal/Project Amount: 

Enter the total award amount for the entire period of performance, inclusive of indirect costs, rounded to the nearest dollar. If the dollar value is not readily ascertainable, a reasonable estimate should be provided. If the support is in a foreign country’s currency, convert to US dollars at time of submission.

Special Instructions for Consortium/Contractual Arrangements or Multi-Project Awards
  • When providing Current and Pending (Other) Support under a consortium/contractual arrangement or that is part of a multi-project award: Indicate the proposal/active project award number, and source of Support for the overall project. Provide all other information (e.g., total anticipated proposal/project amount, person months, etc.) for the subproject only.

*Person-Month(s) (or Partial Person-Months) Per Year Devoted to the Proposal/Active Project: 

Enter how much time the individual anticipates is necessary to complete the scope of work on the proposal and/or active project. Enter the number of person-months (even if unsalaried) for the current budget period and enter the proposed person-months for each subsequent budget period. If the time commitment is not readily ascertainable, a reasonable estimate should be provided.**  

  • **Note: SciENcv requires at minimum 0.01 person months to be entered for any person month entry, and no entry may exceed 12.

    SciENcv Project Entry
  • If you are reporting person months for a project year that spans two calendar years, you should enter the latter year in SciENcv for each project year for which you are reporting person months.
    • For example, for a budget period of July 2025 - June 2026, you would enter 2026 for the year in SciENcv and report the person months for the July 2025 - June 2026 budget period for that project and so on and so forth for additional budget periods for the project.
  • Individuals have a maximum of 100% time or 12 person months in a year.  Note, there is NOT a system check for person month entries across all projects exceeding 12 in any listed year.  Rather, this is reviewed by agency staff upon receipt of a Current and Pending Support submission.
  • PIs must not over commit themselves or others. Distribution of effort must take into account the time required for teaching and campus citizenship.
  • Research-only faculty on 12-month appointments may typically charge up to 95% to sponsored projects year round / 11.4 person month in a year and must reserve a minimum of 5% / 0.6 person months effort for non-sponsored activities.
  • Individual schools may have their own thresholds for how much FTE faculty members must reserve for non-sponsored activities.  
    • In the School of Medicine, all faculty (University Tenure Line, University Medical Line, Non-Tenure Line) must reserve effort commensurate with their non-sponsored activities (e.g., clinical, administrative, teaching, proposal writing); 5% / 0.6 person months being the minimum level of effort which must be reserved for non-sponsored activities (Reference: RPH 3.1) leaving up to 95% effort/11.4 person months available for sponsored research activities.
  • Keeping in mind one of the primary purposes of a Current and Pending document/disclosure is for sponsors to assess the capacity of investigators to take on new projects, the Person-Month(s) or (Partial Person-Months) per year listed for projects should always be a reasonable approximation of how much time the investigator is spending or planning to spend to complete each project, inclusive of unsalaried time and even if a project entirely does not require the direct charging and/or cost sharing of the time the investigator spends completing the project, as is the case for University Research Awards (URAs), Seed Grants, equipment grants, and awards/projects classified as Other Sponsored Activities (OSAs).  
  • Lastly, note any time investigators spend completing projects that is not direct charged and/or cost shared to the benefiting projects:
    1. Cannot be charged to any other sponsored project, and...
    2. Cannot be accounted for within the minimum % of faculty time reserved for non-sponsored activities. (Reference: DoResearch Faculty Effort FAQ # 13 & FAQ #6 ), and...
    3. Must be charged to a non-sponsored source of funding.
Special Instructions for Mentored Career Development Awards (CDA) and Subsumed Effort
  • As outlined in the NIH Grants Policy Statement 12.3.6.1 Mentored CDAs: in cases where Mentored CDA recipients are reporting complementary effort without salary support on other research grants that include related research between the CDA and the research grant, and there is scientific overlap, the percent effort on the research grant is subsumed within the required effort of the CDA. To report this subsumed effort, indicate “Effort Subsumed Under ” as the first text in the “Statement of Potential Overlap” field of the applicable Research Grant.

*Overall Objectives: 

Provide a brief statement of the overall objectives of the proposal/active project. This field is limited to 1500 characters.

*Statement of Potential Overlap: 

Enter a description of the potential overlap with any pending proposal or active foreign or domestic project and this proposal in terms of scope, budget, or person-months planned or devoted to the project by the individual. If there is no potential overlap, enter “none” in this field.

*In-Kind Contributions

An in-kind contribution is a non- cash contribution provided by an external entity that directly supports an investigator’s research and development efforts. An in-kind contribution may include but is not limited to: real property; laboratory space; equipment; data or data sets; supplies; other expendable property; goods and services; employee or student resources. 

In this section, disclose all in-kind contributions with an estimated dollar value of $5000 or more and that require a commitment of the individual’s time. Note, even if an in-kind contribution does not have a formal/documented effort commitment, but it is ACTIVELY being used/benefitting an investigator's research that does = an investigator time commitment.

Some of the most common examples of in-kind contributions/resources Stanford investigators have include, but are not limited to: 

  • Students and post docs with externally funded fellowships who contribute to an investigator's research.
  • Visiting scholars who contribute to an investigator's research.
  • Any other type of lab/research personnel with their own, external funding who contribute to an investigator's research.
  • Access without cost to Non-Stanford labs, equipment, etc. that are used in support of an investigator's research.
  • When investigators have received "things", including but not limited to: mouse models, tissue samples, reagents, services e.g. sample and data analysis that are used in support of an investigator's research.

*Status of Support: Select the appropriate status type as defined below:

  • Current – all in-kind contributions obligated from whatever source irrespective of whether such support is provided through the proposing organization or is provided directly to the individual.
  • Pending – all in-kind contributions currently under consideration from potential funding organizations irrespective of whether such support is provided through the proposing organization or is provided directly to the individual.  

*Receipt (or Anticipated Receipt) Date of In-Kind Contribution: Enter the receipt date (or anticipated receipt date) of the in-kind contribution.

*Source of Support: Identify the entity (entities) that is providing the in-kind contribution. Include, for example, Federal, State, Tribal, territorial, local, foreign, public or private foundations, non-profit organizations, industrial or other commercial organizations, or internal funds allocated toward specific projects.

*Summary of In-Kind Contribution(s): Enter a summary of the in-kind contribution not intended for use on the proposal/active project.

*Person-Month(s) (or Partial Person-Months) Per Year Devoted to the In-Kind Contribution: Enter how much time the individual anticipates is necessary to complete the scope of work associated with use of the in-kind contribution. Enter the number of person- months (even if unsalaried) for the current budget period and enter the proposed person-months for each subsequent budget period.  

  • A 0.01 Person Month (PM) entry may be appropriate for an in-kind resource that is being actively used if the time the investigator is using the in-kind resource is subsumed under the PM reported for any benefiting active projects.  If this is the case, Stanford's recommendation is to indicate within the relevant in-kind resource “Statement of Potential Overlap” field “Effort Subsumed Under ” as the first text and reference the applicable Research Grant.  Likewise, within the “Statement of Potential Overlap” field for the benefiting research project(s) reference the benefiting in-kind resources to cross link the populations.
  • If the time the investigator is using the given in-kind resource is NOT subsumed under the PM reported for any benefiting active projects, then the PM reported for the in-kind resource should be a reasonable estimate of the time the investigator spends and anticipates to spend using the given in-kind resource.

*US Dollar Value of In-Kind Contribution: Enter the US dollar value of the in-kind contribution with an estimated value of $5000 or more. If the dollar value is not readily ascertainable, a reasonable estimate should be provided. If the support is in a foreign country’s currency, convert to US dollars at time of submission, rounded to the nearest dollar.

*Overall Objectives: Provide a brief statement of the overall objectives of the in-kind contribution(s). This field is limited to 1500 characters.

*Statement of Potential Overlap: Enter a description of the potential overlap with any current or pending foreign or domestic in-kind contribution and this proposal in terms of scope, budget, or person-months planned or devoted to the project by the individual. If there is no overlap, enter “none” in the field.

*Certification

Each senior/key person is required to complete the following certifications regarding the information provided in their Current and Pending (Other) Support:

I certify that the information provided is current, accurate, and complete. This includes, but is not limited to, information related to current, pending, and other support (both foreign and domestic) as defined in 42 U.S.C. §6605.

I also certify that, at the time of submission, I am not a party in a malign foreign talent recruitment program.

I also certify that, as senior/key personnel listed within this application, I have taken the required research security training consistent and in compliance with Section 10634 of the CHIPS and Science Act of 2022.

Misrepresentations and/or omissions may be subject to prosecution and liability pursuant to, but not limited to, 18 U.S.C. §§287, 1001, 1031 and 31 U.S.C. §§3729-3733 and 3802.


Special Instructions for Joint University and Department of Veterans Affairs (VA) Appointments

Individuals with joint university and VA appointments may request the university’s share of their salary in proportion to the effort devoted to the research project. The individual’s salary with the university determines the base for computing that request. Signature by the Institutional Official on the application certifies that: (1) the individual is applying as part of a joint appointment specified by a formal Memorandum of Understanding between the university and the VA; and (2) there is no possibility of dual compensation for the same work, or of an actual or apparent conflict of interest regarding such work. Additional information may be requested by the awarding component(s).

When completing Current and Pending (Other) Support, individuals with joint university and VA appointments should use the following additional instructions:

  • Reporting Effort:
    • All effort should be reported as the Person-Month(s) (or Partial Person-Months) Per Year Devoted to the Proposal/Active Project associated with the individual’s appointment at either the University or VA.
    • Individuals should not report the equivalent level of Total Professional Effort.
  • Organizing Current and Pending (Other) Support entries by Appointment:
    • All Proposal/Active Project and/or In-Kind Contribution should be organized by the appointment of the individual.
    • To indicate the appointment affiliated with each Proposal/Active Project or In-Kind Contribution, enter “ Appointment” or “VA Appointment” as the first text in the “Overall Objectives” of each entry

Activities that do NOT require disclosure

  • Recently completed support or support that has ended.
  • Travel supported/paid by an external entity to attend a conference or workshop.
  • Teaching commitments.
  • Startup company based on organization-licensed IP.
  • Stanford startup funds for Stanford investigators.
  • Honoraria or other given for the purpose of conferring distinction or to symbolize respect, esteem or admiration unrelated to research oversight, supervision or co-authorship.
  • Unrestricted gifts*.
  • Training awards and prizes.
  • Mentoring as part of appointment or agreement, or mentor/mentee arrangements that do not involve the individual's research activities.
  • Stanford Academic year salary or Stanford salary provided to Stanford investigators.
  • Stanford core facilities and/or shared equipment that is broadly available to Stanford investigators.
  • Facilities and administrative (F&A) reimbursement provided to Stanford.

*Gifts

*If an item or service meets the definition of a gift, it is not reported. A gift includes any gratuity, favor, discount, entertainment, hospitality, loan, forbearance, license, special access, equipment time, samples, research data or other item having monetary value. A gift also includes services as well as gifts of training, transportation, local travel, lodging, meals, research hours, whether provided in-kind, by purchase of a ticket, payment in advance or reimbursement after the expense has occurred. A gift by definition is given without expectation of anything in return.

An item or service given with the expectation of an associated time commitment or if the donor receives a benefit is not a gift, and is instead an in-kind contribution and must be reported as such if the monetary value is $5K or greater. Examples include, but are not limited to, funds received in support of an Industrial Affiliates Program (IAP) with the expectation of an associated time commitment from the investigator and/or if member companies are offered benefits, and/or gifts where the donor will receive a benefit (e.g. access to research results, students or facilities)

While Stanford University policy on gifts aligns closely with this definition, there may be gifts that could come into question. As a result, we ask Investigators to use the guide document linked below to carefully consider and identify any gift that meets the criteria for disclosure for Common Form Current & Pending Support.

For gifts that do meet the criteria for disclosure and have a current balance of $5K or more*:

  • Use the current gift award balance shown in FFIT as the $ amount of the in-kind resource.  
  • For gifts that are pooled i.e. funded from multiple donors, the source of support can be listed as "multiple donors".

*Disclose any current Seed Grants that are awarded in gift funds as Current projects even if their current balance is less than $5K.  Gift PTAs listed under "Allocations from Others" are very often seed grants.  Running the OBI Fund Authorization Report and speaking with your faculty can confirm and provide any additional needed information.
